We treat your personal data confidentially and in accordance with the provisions of data protection law. This privacy statement informs you about how, to what extent and for what purposes we process the personal data of customers using the MyLittleAdventure website and App.

Subject of data protection is personal data. Data is personal if it can be assigned to an identified or identifiable natural person. This includes information such as names, addresses, email addresses and telephone numbers.

The use of our website and App is generally possible without providing personal data. You are neither obliged to visit this website nor to provide any personal data. If you do not provide us with personal data, you might not be able to use individual functionalities of this website. Otherwise there will be no consequences for you. The collection of users’ personal data on our site is always on a voluntary basis, except in the cases described in the following. MyLittleAdventure may process and use your personal data for marketing purposes, e.g. to send emails with general information or of an advertising nature (newsletter), on the basis of the declaration of consent you have given us.
You can revoke the declarations of consent granted to us in this regard at any time with effect for the future. If you wish to opt-out of receiving these emails from us, please follow the instructions contained in an applicable email you receive from us, which will allow you to opt-out of receiving these types of email communications from us. 4. Information you provide to Payment Processors

All payments made are processed by a PCI/DSS-compliant (these are payment card industry security standards) payment processing service engaged by us. All information collected by these third-party providers for purposes of processing your payments is not available to us unless you have otherwise provided this information to us in connection with your use of the Websites or our products and services.

5. Aggregate Information

We may share your information with affiliated or unaffiliated third parties on an anonymous, aggregate basis. While this information will not identify you personally, in some instances these third parties may be able to combine this aggregate information with other data they have about you, or that they receive from third parties, in a manner that allows them to identify you personally.

III. DATA PROCESSING TO ENABLE THE USE OF THE WEBSITE

When you visit our website, we collect the necessary data to enable you to use it (usage data). VIII. LEGAL BASIS FOR DATA PROCESSING

• (iii.) Where the processing is necessary for us to comply with a legal obligation, we will process your information on basis of GDPR Article 6(1) lit. (c), for example complying in the fields of employment law.
• (iv.) And where the processing is necessary for the purposes of MyLittleAdventure’s’ legitimate interests, such processing will be made in accordance with GDPR Article 6(1) lit. (f), for example to detect fraud.

IX. SOCIAL NETWORKS

Our website contains links to social networks (Facebook, Instagram, Twitter, Google+, Pinterest, LinkedIn). These social networks are operated exclusively by third parties. If you follow the links, information may be transmitted to these third parties. We use the so-called 2-click solution. This means, in general, that no personal data will be passed on if you visit our site.

As far as this is necessary for the initiation or execution of the contract - e.g. to process bookings for activities in countries outside the EU - we will transmit your data outside the EU. The same applies if such a transmission turns out to be necessary for our purposes. In this respect, we ensure that the data recipient guarantees an appropriate level of data protection and that no other interests worthy of protection conflict with the data transmission. MyLittleAdventure relies on derogations as set forth in Article 49 of the GDPR in the event no “adequacy” decision and no other safeguards under the GDPR are in place (for example binding corporate rules on the transfer outside the EEA). In particular, we collect and transfers to countries outside the EU personal data only: with your explicit consent; to perform a contract with you; in a manner that does not outweigh your rights and freedoms. If this data is not processed and transferred, MyLittleAdventure will not be able to execute the contract with you or you will not have access to any or all of the benefits and features associated with your transaction. XIII. DELETION OF DATA

We retain data for the duration of your business relationship with us and otherwise as required under applicable law. Personal data will be kept for no longer than is necessary for the purposes for which your personal data are processed. We will retain your personal data as long as you have a member account or require our services so that we can provide these services to you.
If you are in the European Economic Area, at the moment you withdraw your consent for the processing of your personal data, all your personal data received and stored are erased if no longer needed by us. Unless we are required to retain this personal data by law or to comply with our regulatory obligations. In such a case, we will only keep this personal data for as long as necessary. MyLittleAdventure has taken the necessary technical and organisational measures to protect the personal data provided by you against loss, destruction, manipulation and unauthorized access. Our employees and all persons involved in data processing are obliged to comply with the data protection laws and to treat personal data confidentially. Our employees have been trained accordingly. Both internal and external audits ensure compliance with all data protection processes at MyLittleAdventure.

ACCEPTANCE OF TERMS OF USE

(hereinafter referred to as “MYLITTLEADVENTURE” "we" or “us” or “our”) owns and operates the website, www.MYLITTLEADVENTURE.com, the mobile and touch versions and any sites we have now or in the future that reference these Terms of Use (collectively, "Site"). By using the Site and MYLITTLEADVENTURE’s services through the Site, you agree to these Terms of Use (defined below) and any additional terms applicable to certain programs in which you may elect to participate. You also agree to our Privacy Statement, and acknowledge that you will regularly visit the Terms of Use (defined below) to familiarize yourself with any updates. The Privacy Statement, together with these terms of use, and any other terms contained herein or incorporated herein by reference, are collectively referred to as the "Terms of Use." 1. About the Site

MYLITTLEADVENTURE provides users and suppliers of bookable tourism Uses with this booking platform, where the contracts are concluded directly between the users and the suppliers of tourism Uses.

MYLITTLEADVENTURE is an online Use that enables users to find, and book travel experiences worldwide. MYLITTLEADVENTURE offers a variety of tickets to attractions, activities, events, tours and tourism affiliated Uses (“products”) made available by MYLITTLEADVENTURE's third party suppliers through MYLITTLEADVENTURE's and its affiliates' and distribution partners Platforms and mobile properties and related applications (collectively referred to in this Agreement as this “Platform”).

MYLITTLEADVENTURE does not act as an organizer, lessor, seller, or other contracting partner in relation to the Use contract with the user.

MYLITTLEADVENTURE itself does not offer any tours and is not a contractual party to the contracts that are concluded exclusively between users and suppliers. These MYLITTLEADVENTURE Terms of Use, therefore, shall apply only for the referral of users to suppliers. The Terms of Use of the respective suppliers shall apply for each Use contract between user and supplier.

This Platform is provided to assist customers in discovering tourism information, posting reviews and opinions of tourism experiences, engaging in user generated reviews, and searching for and booking reservations for bookable products, and for no other purposes.

Although MYLITTLEADVENTURE users may rate and review travel experiences based on their own experiences, MYLITTLEADVENTURE does not endorse or recommend the products or Uses of any third-party suppliers.

This Platform and the products and Uses made available on this Platform are offered to you and are conditioned upon your acceptance without modification of any and/or all of the terms, conditions, and notices set forth below (collectively, within the “Agreement”).

By accessing or using this Platform in any way, means or methods, you agree to be bound by the Agreement and acknowledge that you have read and understood its terms. Please read the Agreement carefully, as it contains information regarding your legal rights and limitations on these rights, as well as a section concerning applicable law and jurisdiction of disputes (Grasse, France). If you do not accept all of these terms and conditions, do not use this Platform or book any products or Uses.

In all booking arrangements, the customer making the booking shall be believed to have accepted this Agreement on behalf of the persons named within the booking.

MYLITTLEADVENTURE operates a brokerage-platform providing offers in the tourism sector as bookable offers via the internet and mobile applications ("MYLITTLEADVENTURE").

On the platform, users have the opportunity to find and book tourism related activities including, but not limited to, attractions, events, tourist excursions, activities, and experiences all over the world.

Offers included on the Platform, for example, walking tours, tours by coach, attraction tickets, and other Uses.

Offers are uploaded through the Platform by local suppliers from around the world ("suppliers"), with whom the respective contracts for the Uses are concluded ("Use contracts"). Consumers can research information regarding suppliers’ products and Uses and commence orders on MYLITTLEADVENTURE.

MYLITTLEADVENTURE is directed towards both consumers and business owners ("suppliers"). For the purposes of these Terms of Use and FAQs the following shall apply:

(a) A "consumer" is any natural person using the Platform, commencing and concluding the contract for purposes that cannot be primarily attributed to any commercial or independent professional activity.

(b) A "supplier" is a natural or legal entity or a legal partnership, which, in concluding the contract acts in its commercial or independent professional capacity.

2. Ownership of the Site

The Site, any content on the Site and the infrastructure used to provide the Site are proprietary to us, our affiliates, Merchants and other content providers. By using the Site and accepting these Terms of Use:

(a) MYLITTLEADVENTURE grants you a limited, personal, nontransferable, nonexclusive, revocable license to use the Site pursuant to these Terms of Use and to any additional terms and policies set forth by MYLITTLEADVENTURE; and

(b) you agree not to reproduce, distribute, create derivative works from, publicly display, publicly perform, license, sell or re-sell any content, software, products or services obtained from or through the Site without the express permission of MYLITTLEADVENTURE.

The content and information on this Platform (including, but not limited to, communications, data, collective content, information, soundbites, text, music, sound, photos, graphics, video, maps, icons, software, code, etc.), as well as the infrastructure used to provide content and information, is proprietary to us, MYLITTLEADVENTURE.

Through this agreement, you agree not to otherwise display, perform, reproduce, publish, license, modify, copy, translate, distribute, transmit, create, superimpose, derivative works from, transfer, or sell or re-sell any information, content, software, products or Uses obtained from or through this Platform.

Furthermore, you agree that you, unilaterally, will not and will not assist or enable others to: use this Platform or its individual or collective contents for any commercial or unlawful purpose; make any actions that will or may impose an unreasonable or disproportionately large load on our infrastructure, or create excessive traffic demands on the Platform through those same actions; copy, deep-link, frame, scrape, paste or otherwise incorporate any part of this Platform into any other Platform without our prior authorization in writing; try to gain unauthorized access to the Platform and to user accounts, systems, codes, servers or networks connected to the Platform by any means, or otherwise interfere with any security-related features of the Platform.

3. Use of the Site

As a condition of your use of the Site, you agree that:

• You have reached the age of majority in the country or state in which you reside;
• You are able to create a binding legal obligation;
• You are not barred from receiving products or services under applicable law;
• You will not attempt to use the Site with crawlers, robots, data mining or extraction tools or any other functionality;
• Your use of the Site will at all times comply with these Terms of Use;
• You will only make legitimate purchases that comply with the letter and spirit of the terms of the respective offers;
• You will only make purchases on the Site for your own use and enjoyment or, as a gift for another person;
• You have the right to provide any and all information you submit to the Site, and all such information is accurate, true, current and complete;
• You will update and correct information you have submitted to the Site and ensure that it is accurate at all times (out-of-date information will invalidate your account); and,

You will only purchase a Product or Service or participate in other available programs through the Site by creating an account on the Site, and any purchase will be subject to the applicable Terms of Sale set forth in these Terms of Use.

4. Access to the Site

MYLITTLEADVENTURE retains the right, at our sole discretion, to deny service or use of the Site or an account to anyone at any time and for any reason. While we use reasonable efforts to keep the Site and your account accessible, the Site and/or your account may be unavailable from time to time. You understand and agree that there may be interruptions in service or events, Site access or access to your account due to circumstances both within our control (e.g., routine maintenance) and outside of our control.

5. Modification

We reserve the right at all times to discontinue or modify any part of these Terms of Use in our sole discretion. If we make changes that affect your use of the Site or our services we will post notice of the change on the Terms of Use page. Any changes to these Terms of Use will be effective upon our posting of the notice; provided that these changes will not apply to Merchant Offerings or Products purchased prior to the effective date of such changes. If you do not agree to the changes, you may close your account and you should not use the Site or any services offered through the Site after the effective date of the changes. We suggest that you revisit our Terms of Use regularly to ensure that you stay informed of any changes. You agree that posting notice of any changes on the Terms of Use page is adequate notice to advise you of these changes, and that your continued use of the Site or our services will constitute acceptance of these changes and the Terms of Use as modified.

6. Your Account

You may only create and hold one account on the Site for your personal use . You are responsible for updating and correcting information you have submitted to create or maintain your account. As part of your account settings, you have the option to:

(a) save, edit or delete your personal information, including, without limitation; and

(b) opt-out of persistent login.

You understand and agree that MYLITTLEADVENTURE shall have no responsibility for any incident arising out of, or related to, your account settings. You must safeguard your password and supervise the use of your account. You are solely responsible for maintaining the security of your account and maintaining settings that reflect your preferences. We will assume that anyone using the Site or transacting through your account is you. You agree that you are solely responsible for any activity that occurs under your account.

The Site may permit you to make purchases without an account or without logging in to your account. If you make a purchase in this manner, we will create an account for you based on the information provided to us in connection with the transaction (e.g., your name, address, e-mail address, and other transaction information).

Your account is non-transferrable. You cannot sell, combine, or otherwise share it with any other person. Any violation of these Terms of Use, including, without limitation, failure to maintain updated and correct information about your account (e.g., valid credit card information) will cause your account to fall out of good standing and we may cancel your account in our sole discretion. If your account is cancelled, you may forfeit any pending, current or future account credits (e.g., MYLITTLEADVENTURE Bucks), and any other forms of unredeemed value in your account. Upon termination, the provisions of these Terms of Use that are by their nature intended to survive termination (e.g., any disclaimers, all limitations of liability and all indemnities) shall survive. We also reserve the right to change or discontinue any aspect or feature of our services or the Site, including, without limitation, requirements for use.

MYLITTLEADVENTURE will have no liability with respect to warranties, guarantees, acts, omissions, errors, representations, breaches or negligence of any third-party suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting from your booking or interactions with third-party suppliers. Your interactions with third-party suppliers are at your own risk.

6a. Foreign Currency Conversion Requirements

If the consumer is required to pay in a currency different from his country’s currency, (foreign currency requirement), MYLITTLEADVENTURE may request payment in the consumer’s local currency and convert at the prevailing foreign-exchange rate as determined by MYLITTLEADVENTURE.

Your bank or credit or debit card company may convert the payment into the local currency and charge fees, resulting in differences between the amount displayed on MYLITTLEADVENTURE.com and MYLITTLEADVENTURE-affiliated Platforms, and the final amount charged to your bank account or credit or debit card statement.

Please contact your bank or card company if you have any questions concerning any applicable conversion or fees. Please note for bookings made in Brazil, the tax IOF (Tax Upon Financial Operations, 6.38%) is not included in the final booking value and will be charged to the credit or debit card used to make the purchase.

6aa. Currency Converter

Currency rates are based on publicly available sources and should be used as guidelines only. Rates are not verified as accurate, and actual rates may vary. The information supplied by this Platform is believed to be accurate, but MYLITTLEADVENTURE, and/or its affiliates do not warrant or guarantee such accuracy.

6b. Credit and Debit Card Payments

No refunds are available once a booked product or Use has commenced.

6c. Pricing and Payment Processing

Most of prices on MYLITTLEADVENTURE are displayed per person, and are inclusive of all taxes and fees. Prices are based on the local tariff at the time of quoting. Prices are established by suppliers and may be subject to specific conditions, including, but not limited to, cancellations and refunds. Please check carefully before booking if the respective Use contract is subject to special conditions. Special offers and promotions are identified as such.

Price quotations are subject to change without notice, until a booking has been confirmed.

Prices do not include tips and/or gratuities; insurance; passport and visa fees; baggage fees; taxes or duties; and any personal items, beverages or food not specifically listed under “Inclusions” on the product pages of the Platform.

Under this agreement, the payment processing Uses for Uses purchased on this Platform are provided by EasyPay Limited on behalf of MYLITTLEADVENTURE OU.

These terms are an Agreement between you and MYLITTLEADVENTURE and Uses will be delivered by MYLITTLEADVENTURE directly.

7. Your Conduct

All interactions on the Site must comply with these Terms of Use. To the extent your conduct, in our sole discretion, restricts or inhibits any other user from using or enjoying any part of the Site, we may limit or terminate your privileges on the Site and seek other remedies, including, without limitation, cancellation of your account or forfeiture of any forms of unredeemed value in your account.

The following activities are prohibited on the Site and constitute violations of these Terms of Use:

• Submitting any content to the Site that:
  • Violates applicable laws (including, without limitation, but not limited to intellectual property laws, laws relating to rights of privacy and rights of publicity and laws related to defamation);
  • Contains personal information, except when we expressly ask you to provide such information;
  • Contains viruses or malware;
  • Offers unauthorized downloads of any copyrighted, confidential or private information;
  • Has the effect of impersonating others;
  • Contains messages by non-spokesperson employees of MYLITTLEADVENTURE purporting to speak on behalf of MYLITTLEADVENTURE or provides confidential information concerning MYLITTLEADVENTURE;
  • Contains chain letters of any kind;
  • Is purposely inaccurate, commits fraud or falsifies information in connection with your MYLITTLEADVENTURE account or to create multiple MYLITTLEADVENTURE accounts; or
  • Is protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right.
• Attempting to do or actually doing any of the following:
  • Accessing data not intended for you, such as logging into a server or an account which you are not authorized to access;
  • Scanning or monitoring the Site for data gathering purposes in an effort to track sales, usage, aggregate offering information, pricing information or similar data;
  • Scanning or testing the security or configuration of the Site or breaching security or authentication measures; or
  • Interfering with service to any user in any manner, including, without limitation, by means of submitting a virus to the Site or attempting to overload, “flood,” “spam,” “mail bomb” or “crash” the Site.
• Using any of the following:
  • Frames, framing techniques or framing technology to enclose any content included on the Site without our express written permission;
  • Any Site content, including without limitation User Content (defined below), in any meta tags or any other “hidden text” techniques or technologies without our express written permission;
  • The Site or any of its contents to advertise or solicit, for any commercial, political or religious purpose or to compete, directly or indirectly, with MYLITTLEADVENTURE; or
  • The Site or any of its resources to solicit consumers, Merchants or other third-parties to become users or partners of other online or offline services directly or indirectly competitive or potentially competitive with MYLITTLEADVENTURE, including, without limitation, aggregating current or previously offered deals.
• Collecting any of the following:
  • Content from the Site, including, without limitation, in connection with current or previously offered deals, and featuring such content to consumers in any manner that diverts traffic from the Site without our express written permission; or
  • Personal Information (defined in our Privacy Statement), User Content (defined in Section 12 below) or content of any consumers or Merchants.
• Engaging in any of the following:
  • Tampering or interfering with the proper functioning of any part, page or area of the Site or any functions or services provided by MYLITTLEADVENTURE;
  • Taking any action that places excessive demand on our services or imposes, or may impose, an unreasonable or disproportionately large load on our servers or other portion of our infrastructure (as determined in our sole discretion);
  • Reselling or repurposing your access to the Site or any purchases made through the Site;
  • Exceeding or attempting to exceed quantity limits when purchasing Merchant Offerings or Products, or otherwise using any MYLITTLEADVENTURE account to purchase Merchant Offerings or Products for resale or for speculative, false, fraudulent or any other purpose not expressly permitted by these Terms of Use and the terms of a specific offer on the Site;
  • Accessing, monitoring or copying any content from the Site using any “robot,” “spider,” “scraper” or other automated means or any manual process for any purpose without our express written permission;
  • Violating the restrictions in any robot exclusion headers on the Site or bypassing or circumventing other measures employed to prevent or limit access to the Site;
  • Aggregating any current or previously-offered deals or content or other information from the Site (whether using links or other technical means or physical records associated with purchases made through the Site) with material from other sites or on a secondary site without our express written permission;
  • Deep-linking to any portion of the Site (including, without limitation, the purchase path for any Voucher) without our express written permission;
  • Hyperlinking to the Site from any other website without our initial and ongoing consent; or
  • Acting illegally or maliciously against the business interests or reputation of MYLITTLEADVENTURE, our Merchants or our services.

8. Your Privacy

We take the privacy of your personal data seriously. We encourage you to carefully review our Privacy Statement for important disclosures about ways that we may collect, use, and share personal data and your choices. Our Privacy Statement is incorporated in these Terms of Use, and available here.

8a. Data Protection

MYLITTLEADVENTURE shall collect and use consumer’s personal information to the extent necessary for establishing, creating, arranging, or changing the status of the contractual agreement for MYLITTLEADVENTURE between the consumer and MYLITTLEADVENTURE.

Insofar as MYLITTLEADVENTURE becomes included in the communication regarding a Use contract between the consumer and the respective supplier, it submits the required data necessary for the conclusion of said contract to the supplier.

The supplier then processes and uses the data for the purposes of contract initiation, conclusion, and execution of the contract, based on its own responsibility. The identity of the respective supplier results from the booking dialogue.

9. Terms of Sale

By purchasing or obtaining any Merchant Offering or Product via the Site, you agree to these Terms of Use, including, without limitation, the Terms of Sale, available here.

9a. Suppliers Payments

The contract concluded with the supplier shall regulate the compensation the consumer must pay for the supplier’s Uses. MYLITTLEADVENTURE shall be entitled to prepare invoices for compensation on the supplier’s behalf and to forward these to the consumer. Suppliers will be transferred compensation entitlements from MYLITTLEADVENTURE.

11. Copyright and Trademarks

The Site contains copyrighted material, trademarks, and other proprietary information, including, without limitation, text, software, photos, video, graphics, music and sound, and the entire contents of the Site are protected by copyright, trademark, and other intellectual property laws of the United States. MYLITTLEADVENTURE owns a copyright in the selection, coordination, arrangement and enhancement of such content, as well as in the content original to it. You may not modify, distribute, publish, transmit, publicly display, publicly perform, participate in the transfer or sale, create derivative works or in any way exploit any of the content, in whole or in part. Except as otherwise expressly stated under copyright law, no downloading, copying, redistribution, retransmission, publication or commercial exploitation of the content without the express permission of MYLITTLEADVENTURE or the copyright owner is permitted. If downloading, copying, redistribution, retransmission or publication of copyrighted material is permitted, you will make independent attribution and/or make no changes in or deletion of any author attribution, trademark legend or copyright notice. You acknowledge that you do not acquire any ownership rights by downloading copyrighted material. Any violation of these restrictions may result in a copyright, trademark or other intellectual property right infringement that may subject you to civil and/or criminal penalties.

12. User Content

The Site may provide registered users and visitors various opportunities to submit or post reviews, opinions, advice, ratings, discussions, comments, messages, survey responses and other communications, as well as files, images, photographs, video, sound recordings, musical works, and any other content or material submitted or posted to the Site (collectively, "User Content") through forums, bulletin boards, discussion groups, chat rooms, surveys, blogs or other communication facilities that may be offered on, through, or in connection with the Site from time to time. You may be required to have a MYLITTLEADVENTURE account to submit User Content.

If you contribute any User Content, you will not upload, post or otherwise make available on the Site any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right. MYLITTLEADVENTURE does not have any express burden or responsibility to provide you with indications, markings or anything else that may aid you in determining whether the material in question is copyrighted or trademarked. You will be solely liable for any damage resulting from any infringement of copyrights, trademarks, proprietary rights or any other harm resulting from such a submission. In addition, if you contribute any User Content, you represent and warrant that: (a) you are the creator of the User Content; or (b) if you are acting on behalf of the creator, that you have (i) express, advance authority from the creator to submit or post the User Content, and that they have waived any moral rights in such User Content, and (ii) all rights necessary to grant the licenses and grants in these Terms of Use. You further represent and warrant (or, if you are acting on behalf of the creator of the User Content, you have ensured that the creator represents and warrants) that the use and sharing of the User Content for the purposes you have selected will not violate or infringe any copyrights, trademarks or any other intellectual property rights or rights of third parties, including, without limitation, the rights of publicity or privacy. You represent and warrant that you will not upload, post, transmit or otherwise make available User Content that is unlawful, harmful, tortious, threatening, abusive, harassing, hateful, racist, infringing, pornographic, obscene, violent, misleading, defamatory or libelous, invasive of the privacy of another person or violative of any third-party rights; and that you will not upload, post, transmit, or otherwise make available User Content that contains any material that harbors viruses or any other computer codes, files or programs designed to interrupt, destroy or limit the functionality of any software or computer equipment.

MYLITTLEADVENTURE shall have the sole and absolute right, but not the obligation, to review, edit, post, refuse to post, remove, monitor the User Content and disclose the User Content and the circumstances surrounding its transmission to any third-party, at any time, for any reason, including, without limitation, to determine compliance with these Terms of Use and any operating rules established by MYLITTLEADVENTURE, as well as to satisfy any applicable law, regulation or authorized government request. Without limiting the foregoing, MYLITTLEADVENTURE shall have the right to remove any material from the Communities or any other MYLITTLEADVENTURE controlled sites, in its sole discretion. MYLITTLEADVENTURE assumes no liability for any User Content or other information that appears or is removed from the Site or elsewhere. MYLITTLEADVENTURE has no obligation to use User Content and may not use it at all.

In some instances and from time to time, it may be possible to modify or remove the User Content submitted or posted through your account. MYLITTLEADVENTURE makes no representations or warranties that the User Content you modify or remove will be modified or removed from the Site or elsewhere, or that the User Content will cease to appear on the Internet, in search engines, social media websites, or in any other form, media or technology.

MYLITTLEADVENTURE can alter, restrict, or discontinue its Platform MYLITTLEADVENTURE at any time and at its own discretion. Existing agreements between a consumer and a supplier, as well as their processing, shall not be affected by such changes.

MYLITTLEADVENTURE shall assume no warranty for the accuracy or completeness of the data provided by third parties, such as other suppliers.

MYLITTLEADVENTURE shall assume no liability for the products or Uses offered by suppliers, unless it is itself the supplier of the respective Use. The consumer’s contact point for questions and claims in connection with a Use contract and its implementation shall be MYLITTLEADVENTURE OU.

Just as MYLITTLEADVENTURE bears no obligation toward the user, MYLITTLEADVENTURE also offers no guarantee.

12a. MYLITTLEADVENTURE's Reviews and Ratings Function

Consumers have the opportunity to personally influence MYLITTLEADVENTURE's content by writing travel reports in the form of reviews, ratings or by posting videos, images, or sound bites ("user generated content" or “UGC”).

Consumers are fully responsible for the content posted by them and shall assume responsibility for it.

They shall ensure the correctness of the content and guarantee that it does not contain misleading or improper statements or information. In addition, users shall guarantee that no third party rights are infringed upon by their content. MYLITTLEADVENTURE merely provides the platform and shall in no way assume responsibility for user content.

MYLITTLEADVENTURE can use UGC in various ways. These include, but are not limited to, display on the Platform, reformatting, processing for more clarity or better grammar, and the inclusion in advertisements or other work.

MYLITTLEADVENTURE may remove or re-insert UGC as necessary and at its sole discretion. MYLITTLEADVENTURE can, for example, remove UGC if it is the opinion of MYLITTLEADVENTURE that it violates MYLITTLEADVENTURE's principles on content. MYLITTLEADVENTURE shall not be obligated to retain copies of UGC or provide such copies. MYLITTLEADVENTURE does not guarantee the confidentiality of UGC.

MYLITTLEADVENTURE may display advertisements and other information adjacent to or along with user content on the Platform and in other media. Consumers or suppliers shall not be entitled to compensation for such advertisements. Rights to make changes with respect to the nature and extent of such advertisements shall be reserved, and consumers have no right to be specially notified of these.

Public Nature of Your User Content.

You understand and agree that User Content is public. Any person (whether or not a user of MYLITTLEADVENTURE’s services) may read your User Content without your knowledge. Please do not include any Personal Information in your User Content unless you wish for it to be publicly disclosed. MYLITTLEADVENTURE is not responsible for the use or disclosure of any Personal Information that you disclose in connection with User Content.

Any User Content of any kind made by you or any third-party is made by the respective author(s) or distributor(s) and not by MYLITTLEADVENTURE. Other users may post User Content that is inaccurate, misleading or deceptive. MYLITTLEADVENTURE does not endorse and is not responsible for any User Content, and will not be liable for any loss or damage caused by your reliance on such User Content. User Content reflects the opinions of the person submitting it and may not reflect the opinion of MYLITTLEADVENTURE. MYLITTLEADVENTURE does not control or endorse any User Content, and specifically disclaims any liability concerning or relating to your contribution of, use of, or reliance on any User Content and any actions resulting from your participation in any part of the Site, including, without limitation, any objectionable User Content.

License Grants.

Some User Content you submit to MYLITTLEADVENTURE may be displayed or may give you the option to display in connection with your Personal Information, or a portion of your Personal Information, including, without limitation, but not limited to your name, initials, username, social networking website user account name, image, likeness, preferences, voice and location. You grant MYLITTLEADVENTURE a royalty-free, perpetual, irrevocable, sublicensable, fully paid-up, non-exclusive, transferrable, worldwide license and right to use, commercial use, display and distribute any Personal Information in connection with your User Content in accordance with these Terms of Use, including, without limitation, a right to offer for sale and to sell such rights in Personal Information, whether the User Content appears alone or as part of other works, and in any form, media or technology, whether now known or hereinafter developed, and to sublicense such rights through multiple tiers of sublicensees, all without compensation to you. However, MYLITTLEADVENTURE shall have no obligation to use your Personal Information in connection with any User Content.

As between you and MYLITTLEADVENTURE, you shall retain all ownership rights in and to the User Content you submit or post. However, by contributing User Content or other information on or through the Site, you grant MYLITTLEADVENTURE a royalty-free, perpetual, irrevocable, sublicensable, fully paid-up, non-exclusive, transferrable, worldwide right and license to use, reproduce, create derivative works from, publish, edit, translate, distribute, perform, display, transmit, offer for sale and sell the User Content alone or as part of other works in any form, media or technology, whether now known or hereafter developed, and to sublicense such rights through multiple tiers of sublicensees and without compensation to you. You waive any "moral rights" or other rights with respect to attribution of authorship or integrity of materials regarding the User Content that you may have under any applicable law under any legal theory. MYLITTLEADVENTURE’s license in any User Content or Personal Information submitted includes, but is not limited to, use for promotions, advertising, marketing, market research, merchant feedback, quality control or any other lawful purpose.

As detailed in Section 3, contributing User Content or other information on or through the Site, is limited to individuals who are over the age of majority in the state or province in which they reside. The Site is designed and intended for adults. By contributing User Content or other content on or through the Communities, you affirm that you are over the age of majority in the state or province in which they reside. We will promptly delete User Content or other content associated with any account we obtain actual knowledge of that is associated with a registered user who is not at least the age of majority in the state or province in which he or she resides.

13. Unsolicited Ideas

We do not accept or consider, directly or through any MYLITTLEADVENTURE employee or agent, unsolicited ideas of any kind, including without limitation, ideas or suggestions relating to new or improved products, enhancements, names or technologies, advertising and marketing campaigns, plans or other promotions. Do not send us (or any of our employees) any unsolicited ideas, suggestions, material, images or other work in any form (“Unsolicited Materials”). If you send us Unsolicited Materials, you understand and agree that the following terms will apply, notwithstanding any cover letter or other terms that accompany them:

MYLITTLEADVENTURE has no obligation to review any Unsolicited Materials, nor to keep any Unsolicited Materials confidential; and

MYLITTLEADVENTURE will own, and may use and redistribute, Unsolicited Materials for any purpose without restriction and free of any obligation to acknowledge or compensate you.

14. Registration

You need to create an account and provide information about yourself in order to use some of the features on the Platform. Consumers shall treat registration data (user name and password) as confidential and shall not allow third parties access to MYLITTLEADVENTURE with their registration data.

By holding a MYLITTLEADVENTURE account, you will safeguard your account information and will supervise and be completely responsible for any use of your account by anyone other than you.

Use of MYLITTLEADVENTURE under the registration of the consumer shall be attributed to the consumer. Unauthorized use of your password or account could cause you to incur liability to both MYLITTLEADVENTURE OU and other suppliers and/or consumers.

You are responsible for maintaining the confidentiality of your account password and login credentials.

You are responsible for all activities that occur in connection with your account. You agree to notify us immediately of any unauthorized use of your account.

Your MYLITTLEADVENTURE account is for your personal, non-commercial use only. You may not impersonate someone else, create an account for anyone other than yourself, provide an email address other than your own, or create multiple accounts.

The consumer shall indemnify MYLITTLEADVENTURE from claims by third parties resulting from his use of MYLITTLEADVENTURE.

MYLITTLEADVENTURE reserves the right to close or suspend your account/registration at any time for any or no reason.

You may terminate your account at any time by closing your account and discontinuing your use of any and all parts of the Platform. If you close your account, we may continue to display your previously published Content and are under no obligation to remove any of your Content.

Furthermore, as a condition of your use of this Platform, you warrant that all information supplied by you on this Platform is true, accurate, current and complete.

Your use of this Platform is intended for personal, noncommercial use and/or to make legitimate requests to book the Products offered. MYLITTLEADVENTURE OU retains the right at our sole discretion to deny access to anyone to this Platform and the Uses we offer, at any time and for any reason, including, but not limited to, for violation of this Agreement.

In accessing or using the Platform, you may be exposed to content that is inaccurate, objectionable, or otherwise inappropriate. MYLITTLEADVENTURE does not endorse such content, and therefore, you access and use the Platform at your own risk.

15. Use and Conclusion of Contract

After the consumer has initiated a request for Use (for example, requested information on a tour, dates and price options) on the MYLITTLEADVENTURE Platform. MYLITTLEADVENTURE will show the consumer information on the supplier’s Uses ("Use information"). Based on information received by the Platform and after checking availability, the consumer can then submit a contractual offer to be forwarded to the supplier by submitting an order. This is done by clicking the "book" button.

MYLITTLEADVENTURE shall provide the consumer with the supplier’s conditions of carriage and general terms and conditions for its relationship to the consumer and for its products and/or Uses, to the extent that these are available to MYLITTLEADVENTURE.

The use of MYLITTLEADVENTURE itself is, in principle, free of charge to the consumer.

MYLITTLEADVENTURE shall forward any data for the use of suppliers’ Uses in accordance with the currently valid conditions and cancellation clauses/penalties after these have been received from the supplier.

MYLITTLEADVENTURE does not provide any warranties or guarantees for the accuracy of data forwarded or guarantee the performance or quality of the experience of products or Uses by the supplier, because all information displayed and forwarded to the consumer is based on data provided by third parties or suppliers, which MYLITTLEADVENTURE cannot verify in detail.

By booking a reservation for a Product through the Platform, you thoroughly acknowledge that you accept the practices described in our Privacy Policy and this Agreement, in whole.

In addition, you warrant that you possess the legal authority to enter into this Agreement, use this Platform, book the product and/or Use, and that all of the requested information that you supply is true and accurate.

Furthermore, you agree that you will use the booking functionality of this Platform to make only legitimate reservations for you and/or others for whom you are legally authorized to act.

Any false or fraudulent reservation is prohibited, and any consumer who attempts such a reservation will have his or her MYLITTLEADVENTURE account terminated.

Although MYLITTLEADVENTURE displays information about travel experiences offered by third-party suppliers and facilitates reservations to those suppliers, these actions do not in any way imply, suggest, or constitute MYLITTLEADVENTURE's approval of third-party suppliers, or any affiliation between MYLITTLEADVENTURE and third-party suppliers.

You agree that MYLITTLEADVENTURE is not responsible for the accuracy or completeness of information it obtains and displays from third-party suppliers on its Platform.

If you book a reservation for a travel experience through the Platform, you agree to accept and be bound by the supplier's terms and conditions, and any other rules or policies related to the supplier's products and Uses.

15. Disclaimer of Warranty

YOU EXPRESSLY AGREE THAT USE OF THE SITE IS AT YOUR SOLE RISK. NONE OF MYLITTLEADVENTURE, ITS SUBSIDIARIES OR AFFILIATES OR ANY OF THEIR RESPECTIVE EMPLOYEES, AGENTS, MERCHANTS, THIRD-PARTY CONTENT PROVIDERS OR LICENSORS OR ANY OF THEIR OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS, WARRANT THAT USE OF THE SITE WILL BE UNINTERRUPTED, SECURE, VIRUS-FREE OR ERROR FREE, NOR DO THEY MAKE ANY WARRANTY AS TO (A) THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SITE, OR (B) THE ACCURACY, COMPLETENESS OR RELIABILITY OF (I) THE CONTENT ON THE SITE, INCLUDING, WITHOUT LIMITATION, MERCHANT OFFERINGS, PRODUCTS OR OTHER AVAILABLE PROGRAMS, (II) DESCRIPTIONS OF MERCHANT OFFERINGS, PRODUCTS OR OTHER AVAILABLE PROGRAMS, OR (III) USER CONTENT PROVIDED THROUGH THE SITE. THE SITE AND ALL CONTENT, USER CONTENT AND OTHER INFORMATION CONTAINED ON THE SITE, MERCHANT OFFERINGS, PRODUCTS AND OTHER AVAILABLE PROGRAMS ACCESSIBLE OR AVAILABLE THROUGH THE SITE, ARE MADE ACCESSIBLE OR AVAILABLE ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE EXTENT ALLOWED BY APPLICABLE LAW, MYLITTLEADVENTURE HEREBY DISCLAIMS ANY AND ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED, OR STATUTORY, AS TO THE OPERATION OF THE SITE OR THE CONTENT, USER CONTENT OR OTHER INFORMATION CONTAINED ON THE SITE OR THE MERCHANT OFFERINGS, PRODUCTS OR OTHER AVAILABLE PROGRAMS ACCESSIBLE OR AVAILABLE THROUGH THE SITE, INCLUDING, WITHOUT LIMITATION, THOSE OF TITLE, NON-INFRINGEMENT, NON-INTERFERENCE, MERCHANTABILITY, SUITABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AS WELL AS WARRANTIES IMPLIED FROM A COURSE OF PERFORMANCE OR COURSE OF DEALING.

17. Limitation of Liability

IN NO EVENT SHALL MYLITTLEADVENTURE, ITS SUBSIDIARIES OR AFFILIATES OR ANY OF THEIR RESPECTIVE EMPLOYEES, OFFICERS, DIRECTORS, AGENTS, MERCHANTS, PARTNERS, THIRD-PARTY CONTENT PROVIDERS OR LICENSORS, OR ANY OF THEIR OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, LOST PROFIT, LOST BUSINESS, OR PUNITIVE DAMAGES ARISING OUT OF, RELATED TO, OR IN CONNECTION WITH ANY OF THE FOLLOWING: (A) YOUR USE OF THE SITE, THE CONTENT, USER CONTENT, INCLUDING, WITHOUT LIMITATION, ANY PERSONAL INFORMATION, AND ANY OTHER INFORMATION EITHER CONTAINED IN THE SITE OR SUBMITTED BY TO YOU TO THE SITE; (B) YOUR INABILITY TO USE THE SITE; (C) MODIFICATION OR REMOVAL OF CONTENT SUBMITTED ON THE SITE; (D) THE MERCHANT OFFERINGS, PRODUCTS AND OTHER AVAILABLE PROGRAMS ACCESSIBLE OR AVAILABLE THROUGH THE SITE; (E) ANY PRODUCTS OR SERVICES OTHER THAN MERCHANT OFFERINGS PURCHASED OR OBTAINED FROM A MERCHANT; (F) THESE TERMS OF USE; OR (G) ANY IMPROPER USE OF INFORMATION YOU PROVIDE TO THE SITE, INCLUDING, WITHOUT LIMITATION, ANY PERSONAL INFORMATION. IN NO EVENT WILL MYLITTLEADVENTURE’S LIABILITY IN CONNECTION WITH A MERCHANT OFFERING, PRODUCT, AND OTHER AVAILABLE PROGRAMS EXCEED THE AMOUNTS PAID FOR THE APPLICABLE VOUCHER, PRODUCT OR SERVICE. TOTAL AGGREGATE LIABILITY ARISING OUT OF, RELATED TO, OR IN CONNECTION WITH (A)-(G) ABOVE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU DURING THE SIX MONTHS PRECEDING THE BRINGING OF ANY CLAIM. YOU AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF, RELATED TO, OR IN CONNECTION WITH (A)-(G) ABOVE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OR THE CAUSE OF ACTION IS PERMANENTLY BARRED. BECAUSE SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, ALL OR A PORTION OF THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

20. Indemnification/Release

You agree to defend, indemnify and hold harmless MYLITTLEADVENTURE, its subsidiaries and affiliates and their respective directors, officers, employees and agents from and against all claims and expenses, including, without limitation, attorneys’ fees, arising out of, related to, or in connection with any of the following: (a) any Merchant Offerings or Products purchased by you through the Site or any additional products or services purchased or obtained by you from the Merchant; (b) any User Content submitted or posted by you, in connection with the Site, or any use of the Site in violation of these Terms of Use; (c) fraud you commit or your intentional misconduct or gross negligence; or (d) your violation of any applicable laws or rights of a third-party.

You are solely responsible for your interactions with Merchants and other users of the Site. To the extent permitted under applicable laws, you hereby release MYLITTLEADVENTURE from any and all claims or liability related to any product or service of a Merchant, regardless of whether such product or service is a Merchant Offering available through the Site, any action or inaction by a Merchant, including, without limitation, but not limited to any harm caused to you by action or inaction of a Merchant, a Merchant’s failure to comply with applicable law and/or failure to abide by the terms of a Merchant Offering or any other product or service purchased or obtained by you from the Merchant, and any conduct, speech or User Content, whether online or offline, of any other third-party.

21. Force Majeure

MYLITTLEADVENTURE shall be excused from performance under these Terms of Use, to the extent it is prevented or delayed from performing, in whole or in part, as a result of an event or series of events caused by or resulting from: (a) weather conditions or other elements of nature or acts of God; (b) acts of war, acts of terrorism, insurrection, riots, civil disorders or rebellion; (c) quarantines or embargoes; (d) labor strikes; (e) error or disruption to major computer hardware or networks or software failures; or (g) other causes beyond the reasonable control of MYLITTLEADVENTURE.

22. Assignment

You may not assign these Terms of Use, or any rights, benefits or obligations hereunder, by operation of law or otherwise, without the express written permission of MYLITTLEADVENTURE. Any attempted assignment that does not comply with these Terms of Use shall be null and void. MYLITTLEADVENTURE may assign these Terms of Use, in whole or in part, to any third-party in its sole discretion.

23. Entire Agreement

The Terms of Use, including, without limitation, the incorporated Terms of Sale, Privacy Statement and other terms incorporated by reference, constitute the entire agreement and understanding between you and MYLITTLEADVENTURE with respect to the subject matter hereof and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and MYLITTLEADVENTURE with respect to such subject matter.

MYLITTLEADVENTURE reserves the right to modify these Terms of Use at any time without notice and without stating reasons for doing so. The amended Terms of Use will be posted on the Platform at least two weeks before they take effect.

Jurisdiction and Governing Law

This Platform is operated by a French entity and this Agreement is governed by the laws of France. You hereby consent to the exclusive jurisdiction and venue of courts in France stipulate to the fairness and convenience of proceedings in such courts for all disputes arising out of or relating to the use of this Platform. You agree that all claims you may have against MYLITTLEADVENTURE, Inc. arising from or relating to this Platform must be heard and resolved in a court of competent subject matter jurisdiction located in France. Use of this Platform is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including, without limitation, this paragraph.

Other Provisions

The law of France shall apply. The exclusive place of jurisdiction shall be Grasse, France. This country really exists and is in the European Union. Look it up.

General Provisions

This Agreement constitutes the entire agreement between you and MYLITTLEADVENTURE with respect to this Platform and it supersedes all prior communications, whether electronic, oral, or written, between the customer and MYLITTLEADVENTURE with respect to this Platform.

25. Additional Disclosures

No waiver by either you or MYLITTLEADVENTURE of any breach or default or failure to exercise any right allowed under these Terms of Use is a waiver of any preceding or subsequent breach or default or a waiver or forfeiture of any similar or future rights under our Terms of Use. The section headings used herein are for convenience only and shall be of no legal force or effect. MYLITTLEADVENTURE has no liability and will not make refunds in the event of any delay, cancellation, overbooking, strike, force majeure or other causes beyond their direct control; MYLITTLEADVENTURE OU have no responsibility for any additional expense, omissions, delays, re-routing, government or other authorities actions.

In no event shall MYLITTLEADVENTURE or their officers, directors, distribution and affiliate partners be liable for any direct, indirect, punitive, incidental, special, exemplary or consequential damages (including, but not limited, to the loss of data or information, or information or costs to procure substitute goods or Uses) arising from, or in any way connected with, product or Use bookings made by you through this platform, or your access to, display of, or use of this platform or with the delay or inability to access, display of, or use of this platform (including, but not limited to, your reliance upon reviews or opinions appearing on this platform; any computer viruses, information, software, linked sites, products, and Uses obtained through this platform; or otherwise arising out of the access to display of or use of the platform) whether based on a theory of negligence, contract, tort, strict liability or otherwise, and even if MYLITTLEADVENTURE has been advised of the possibility of such damages.

If MYLITTLEADVENTURE are found liable for any loss or damage that arises out of or is in any way connected with your use of our Platforms or your booking or use of Products or Uses made available through our Platform, then the MYLITTLEADVENTURE liabilities will in no event exceed, in the aggregate, the greater of (a) the transaction fees paid to MYLITTLEADVENTURE for the transaction(s) on this Platform giving rise to the claim, or (b) One-Hundred Dollars USD (US $100.00).

Your Liability

You agree to defend and indemnify MYLITTLEADVENTURE and all of their respective officers, directors, employees and agents from and against any claims, causes of action, demands, suits, proceedings, investigations, losses, damages, fines, penalties, fees, expenses, costs, and any other liabilities of any kind or nature including, but not limited to, reasonable legal and accounting fees, arising out of or related to your breach of this Agreement or the documents referenced herein; your violation of any law, rule, regulation or guideline; your violation, infringement or misappropriation of the rights of a third party, including without limitation any rights of publicity or privacy; your use of this Platform; your booking or use of any products or Uses obtained through this Platform; or your negligence or willful misconduct.
